Registration fees
The case of built property
Reduced rate of 4 per cent:
When you purchase a property for residential, commercial, professional or administrative use, you will be liable for registration fees at the reduced rate of 4 per cent. This same rate also applies when such premises are purchased by credit institutions or similar organisations, as part of commercial or financial transactions such as ‘Murabaha’ contracts, ‘Ijara Mountahia Bitamlik’ or ‘Moucharaka Moutanakissa’. The land on which these premises are built is also subject to the 4% rate, up to a limit of five times the total covered area.
Reduced rate of 3 per cent:
The first sale of social housing* and low-value properties, as well as the first acquisition of such properties by credit institutions and similar bodies as part of commercial or financial transactions such as ‘Murabaha’-type contracts, ‘Ijara Mountahia Bitamlik’ or ‘Moucharaka Moutanakissa’, are subject to a reduced rate of 3 per cent.
* Any residential unit with a floor area of between 50 and 80 square metres and a sale price not exceeding 250,000 dirhams, excluding value added tax.
** Any residential unit with a floor area of between 50 and 60 square metres and a price on first sale not exceeding 140,000 dirhams.
Reduced rate of 1.5 per cent (in the case of gifts):
Statements made by the donee or their representatives, where these are made in the context of direct family relationships such as direct lineal relatives, spouses, siblings, as well as between the person acting as Kafala guardian and the child in their care (in accordance with the regulations in force relating to the kafala of abandoned children), are subject to a reduced rate of 1.5 per cent.
The case of land
5 per cent
Deeds and agreements relating to the acquisition, whether for consideration or free of charge, of land (or rights in rem relating to land), whether bare or comprising buildings intended for demolition, whether registered or not, are subject to a rate of 5 per cent.
This same rate also applies to deeds and agreements relating to the acquisition of undeveloped land or land containing buildings intended for demolition by credit institutions and similar bodies, in the context of commercial or financial transactions such as ‘Murabaha’-type contracts, ‘Ijara Mountahia Bitamlik’ or ‘Moucharaka Moutanakissa’.
N.B.: To avoid any penalties or surcharges, documents must be registered within thirty days of the date on which they were drawn up.
